all of our efforts to settle the above matter amicably have been unsuccessful. we have made numerous attempts to reach you to no avail. we have delayed legal proceedings up to this point based on your assurances that we would receive payment in full by feb. 15th, 2014, but those assurances have fallen short. for your reference, i am enclosing copies of letters that have been written on your behalf stating that the matter would now be closed, which indicate your failed intention to live up to those expectations.

as a result, you have left us no choice but to proceed legally and we will be filing suit immediately. we have attempted to handle this matter in a civil, understanding manner, but your lack of communication and the fact that the due date has passed without payment have caused us to lose patience in the matter. this matter is now being turned over to our accountant, and we are proceeding accordingly.
